to give the advice to the best of their ability, both officials as well as unofficials, and they are bound to give sufficient reasons for the advice they give.

Neither of these conditions is fulfilled by the mere adoption of an order or request from the Secretary of State.

Your Excellency during our interview, seemed dis- -posed to question the position that the recutive Council must give reasons for their action. But it is unquestionable that the arbitrary

exercise of power is unknown to the law of England save in the sole instance of the exercise of the King's prerogative, the sanction in

respect of an abuse of this power being in Parliament. No man can be deprived of his rights without just reason given. Subject only to

the exercise of the prerogative right which does not arise in this

case, or the existence of a just cause for dismissal, which has not

been alleged in this case. I have a right to remain in the civil

service if I am physically competent so long as I administer justice

rightly until the age of 65. The Executive Council propose to curtail

this right, and the only reason apparent from Your Excellency's letter

is that the Secretary of State desires it. This is not an in-

-dependent exercise of their advisory functions. There is a reference

in Your Excellency's letter to "a number of considerations", but

they are not specified, and it is not possible to dismiss an officer

from the service in so vague a manner. Further, no man can be depriv-

-ed of his rights without a hearing; and if the decision is persisted

in I must request to be allowed to state my case fully before the

Executive Council. I deem this to be of the greatest importance not

only in justice to myself but also in the interests of the Colony,

because the question turns on merits or demerits of a scheme affect-

-ing in the most vital manner the administration of justice in the

Colony, and (1) the scheme was never submitted to me Before it was

approved, (2) the opinion of the legal profession has never been

taken on it, and (3) it is obvious that its many grave defects have

not been present to the Executive Council while assenting to the decision to dismiss me on account of my opposition to it.
